Auto Insurance

Texas is considered a fault state when it comes to determining liability in a car accident, and it means that the driver must pay for any accident that they cause. Any injured driver, passenger, or pedestrian can file a "first-party" claim with their auto insurance provider if an accident happens. In addition, the injured party can also seek compensation from the other driver's insurance company by filing a third-party claim. Lastly, the injured party may also file a lawsuit against the at-fault driver and seek compensation for pain and suffering, medical bills, property damages, and any other losses sustained in the accident.

Given that Texas is a fault state, motorists must meet at least the minimum requirements for auto insurance by demonstrating their financial responsibility to pay for any accident they cause. To that end, Texas law requires that vehicle owners maintain the following minimum auto insurance coverage:

  • $30,000 Bodily injury liability per person injured
  • $60,000 Total bodily injury liability for two or more people injured
  • $25,000 Property damage per accident

This basic coverage, also known as "30/60/25" coverage, pays the medical bills, property damage, bills, and other costs associated with third-party injuries and damages up to your coverage limits for covered accidents that you cause. You can and likely should purchase additional coverage to protect you in an accident better, as these coverage limits are unlikely to be sufficient for serious crashes resulting in injuries and vehicle damage.
